Abstract

The emergence of non-state armed groups (NSAGs) has made armed conflicts in the 21st century increasingly complex. These groups often violate international humanitarian law but are frequently not held accountable. Based on the Rome Statute, the international community established the International Criminal Court (ICC) to address this issue, the role of the Rome Statute in ensuring accountability for international crime perpetrators, particularly those committed by non-state armed groups. Using a normative method, this research examines the relevant provisions in the Rome Statute, as well as their application in cases involving non-state armed groups. The research findings indicate that the Rome Statute has provided a strong legal framework for prosecuting individuals responsible for serious crimes such as genocide, crimes against humanity, and war crimes, including those committed by members of non-state armed groups. However, there are several challenges in the implementation of the Rome Statute, such as issues of jurisdiction, evidence, and international cooperation. This research concludes that although there are still obstacles, the Rome Statute remains an important legal instrument in the effort to achieve international peace and justice. often violate international humanitarian law but are frequently not held accountable.
