IMPLEMENTASI PERLINDUNGAN HUKUM PADA JURNALIS ASING DI INDONESIA

Freedom of the press is essential for Indonesian democracy and the protection of human rights. Freedom of the press is still limited, especially for foreign journalists, despite strong legal foundations, such as Law No. 40 of 1999 concerning the Press and Government Regulation (PP) Number 31 of 2013 concerning the Implementing Regulations of Law Number 6 of 2011 concerning Immigration. The background of this study aims to examine the current laws and practices of protection used by foreign journalists, with a particular emphasis on efforts to stop the intimidation and criminalization they face. Freedom of the press is a constitutional right, but there are many rules that can be abused that hinder it. The case of the criminalization of journalists shows how important it is to improve legal protection, to make the working environment of journalists safer is the focus of the study. The research method used is normative research, by analyzing the laws and regulations in force in Indonesia and reviewing policies in other countries as references. This approach allows researchers to evaluate the effectiveness of existing regulations and seek inspiration from practices and conceptual approaches to help understand the philosophical and social context of press freedom, as well as the difficulties faced by journalists. The research findings show that, despite laws supporting press freedom, this freedom is often abused to suppress critical opinions. Regulatory reform is needed to reduce the potential for criminalization of foreign journalists and raise awareness of the importance of legal protection for them to improve workplace security in Indonesia. With the right policies, it is hoped that foreign journalists can operate more safely and efficiently, and make a greater contribution to the diversity of information in Indonesia.
